Aterx Hobby = Terms of Service (Short Form)

1. Acceptance of Terms 

By accessing or using any part of the Aterx Hobby website, services, or software (collectively, the 'Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree, you must stop using the Service immediately. 

2. Permitted Use 

You may use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all activity that occurs under your account. 

3. Intellectual Property 

All content, trademarks, logos, and software provided by Aterx Hobby are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written permission. 

4. Disclaimer of Warranties 

THE SERVICE IS PROVIDED 'AS IS,' 'AS AVAILABLE,' AND 'WITH ALL FAULTS.' ATERX HOBBY MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: 

    Implied warranties of merchantability, fitness for a particular purpose, and non infringement;  
    Any guarantee that the Service will be uninterrupted, error free, secure, or meet your expectations.
     

5. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATERX HOBBY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY: 

    Direct, indirect, incidental, special, consequential, or punitive damages;  
    Loss of profits, revenue, data, use, goodwill, or other intangible losses;  
    Any other damages arising out of or in any way connected with your use of or inability to use the Service,
     

EVEN IF ATERX HOBBY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.   

6. Indemnification 

You agree to defend, indemnify, and hold harmless Aterx Hobby and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: 

    Your breach of these Terms;  
    Your misuse of the Service;  
    Your violation of any applicable law or third party right.
     

7. Governing Law & Dispute Resolution 

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the courts of the Province of Ontario. 

8. Changes to the Terms 

We may revise these Terms at any time, at our sole discretion. Continued use of the Service after a revision constitutes your acceptance of the updated Terms. Material changes will be posted on our website or otherwise communicated to you.
